LIMITED LIFETIME HULL WARRANTY
This Limited Lifetime Hull Warranty ("Warranty") is provided by Atchafalaya Aluminum
Boats LLC, located in Maryland, USA ("Atchafalaya," "we," "us," or "our") to the original retail
purchaser ("Original Owner," "you," or "your") of the Atchafalaya aluminum boat identified
above (the "Boat"). This Warranty is subject to the terms, conditions, and limitations set
forth below.
PLEASE READ THIS DOCUMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION
ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS
THAT MAY APPLY TO YOU.
1. WHAT THIS LIMITED WARRANTY COVERS
1.1. Lifetime Hull Warranty:
Atchafalaya Aluminum Boats LLC warrants to the Original Owner that the aluminum hull and its primary aluminum structural components (as defined in Section 1.2) of the Boat will be free from defects in materials and workmanship, under Normal Recreational and Commercial Use (as defined in Section 3.1), for the duration of the Original Owner’s ownership of the Boat (the "Lifetime Hull Warranty Period").
1.2. Covered Structural Components:
This Lifetime Hull Warranty applies specifically to the following factory-installed aluminum components:
o Welded aluminum hull plating and associated welded hull framing components (including stringers, ribs, and cross-members).
o Welded aluminum bulkheads integral to the hull structure.
o Welded aluminum transom structure.
o Welded aluminum reinforcement plates integral to the hull structure.
o Welded integral aluminum flotation compartments (warranty applies to the structural integrity of the compartment welds and material, not to the flotation material itself if damaged by other causes).
1.3. Our Obligation:
If a defect in materials or workmanship in a Covered Structural Component is discovered during the Lifetime Hull Warranty Period and reported to Atchafalaya Aluminum Boats LLC in accordance with Section 5, Atchafalaya Aluminum Boats LLC will, at its sole option and discretion:
o Repair the defective component;
OR
o Replace the defective component. Repairs or replacements under this Warranty will be performed by Atchafalaya Aluminum Boats LLC or an authorized Atchafalaya Aluminum Boats LLC service facility. The decision to repair or replace will be made by Atchafalaya Aluminum Boats LLC. Any repaired or replaced component will be warranted for the remaining duration of the original Lifetime Hull Warranty Period.
2. WARRANTY TRANSFERABILITY TO A SECOND OWNER
2.1. Fifteen-Year Transferable Hull Warranty:
The Lifetime Hull Warranty provided to the Original Owner may be transferred ONCE to a second private retail owner (the "Second Owner") for a period not to exceed fifteen (15) years from the Effective Date of the original purchase by the Original Owner, provided the following conditions are met:
o The Original Owner (or the Second Owner, with proof of purchase from the Original Owner) must submit a written warranty transfer request to Atchafalaya Aluminum Boats LLC within sixty (60) days of the date of the Second Owner’s purchase of the Boat.
This request must include:
▪ A copy of the original bill of sale to the Original Owner.
▪ A copy of the bill of sale from the Original Owner to the Second Owner.
▪ Contact information for the Second Owner.
▪ The Hull Identification Number (HIN).
2.2. Limitations on Transferred Warranty:
The transferred warranty is subject to all terms, conditions, exclusions, and limitations contained in this document. The warranty period for the Second Owner will expire fifteen (15) years from the Effective Date of the original purchase by the Original Owner, regardless of when the transfer occurred. This warranty is only transferable beyond the Second Owner at Atchafalaya Aluminum Boats LLC's discretion.
2.3. Failure to Transfer:
Failure to properly complete the warranty transfer procedure as outlined above within the specified timeframe will result in the termination of this Warranty coverage for any subsequent owner.
3. WHAT THIS LIMITED WARRANTY DOES NOT COVER (EXCLUSIONS & LIMITATIONS)
This Warranty is comprehensive but does not cover everything. The following are excluded:
3.1. Normal Use Definition:
"Normal Use" means use of the Boat for boating activities for which it was designed and intended, and expressly excludes improper trailering, or operation in a manner inconsistent with the recommendations in the Owner's Manual provided by Atchafalaya Aluminum Boats LLC.
3.2. Commercial Purposes:
This Warranty covers your boat being used for commercial purposes, including but not limited to: rental, charter, fishing guide services, law enforcement, military, patrol, or any other income-generating activity. However, the vessel is required to operate within the bounds of which it was designed and intended for, as outlined by Atchafalaya Aluminum Boats LLC. Any damage caused by the vessel being used in a use case outside of the scope of which it was designed and intended for by Atchafalaya Aluminum Boats LLC will not be covered.
3.3. Normal Wear, Tear, and Environmental Exposure:
o Superficial or cosmetic imperfections such as scratches, dents, scuffs, discoloration, chalking, or fading of paint, coatings, or aluminum surfaces.
o Normal aging, weathering, or deterioration of adhesives, sealants, lubricants, rubberized components, or protective finishes.
o Gradual aluminum oxidation or corrosion due to normal environmental exposure, provided it does not affect the structural integrity of a Covered Structural Component. (Note: Proper maintenance, including regular rinsing after saltwater use and maintenance of anodes if applicable, as outlined in the Owner’s Manual, is required to minimize corrosion).
3.4. Owner Misuse, Negligence, Improper Care, or Accidents:
o Damage caused by operation in unsafe or reckless conditions, excessive speed, harsh impacts (e.g., collision with submerged nonorganic objects, docks, other vessels), jumping waves in a manner that overstresses the hull beyond which it was designed and intended by Atchafalaya Aluminum Boats LLC.
o Damage from overloading beyond the Boat's certified weight or passenger capacity as stated on the US Coast Guard capacity plate.
o Damage due to improper docking, mooring, trailering, launching, hauling, or securing of the Boat.
o Damage resulting from improper maintenance, including failure to perform regular cleaning, lubrication, inspection, winterization, or other procedures recommended in the Owner’s Manual.
o Use of harsh or abrasive cleaning agents, solvents, or chemicals not recommended in the Owner's Manual that damage aluminum, coatings, or finishes.
o Damage from improper storage conditions, such as prolonged exposure to extreme temperatures or moisture retention without adequate ventilation or from prolonged UV exposure or exposure to the elements.
o Damage from accidents, fire, theft, vandalism, acts of God (e.g., hurricanes, floods, lightning), or other external forces beyond Atchafalaya Aluminum Boats LLC's control. (If being used for Search and Rescue Operations, promptly notify Atchafalaya Aluminum Boats LLC and provide proof of use for such efforts. Atchafalaya Aluminum Boats LLC may cover and repair damages caused during these operations at Atchafalaya Aluminum Boats LLC's discretion.)
o Damage incurred during transportation or shipping arranged by the Owner.
3.5. Environmental & Chemical Exposure (where due to neglect or abnormal conditions):
o Severe corrosion or pitting due to failure to rinse the Boat thoroughly with fresh water after each use in saltwater or polluted water, or failure to maintain protective coatings or anodes as specified in the Owner's Manual.
o Damage from electrolysis or galvanic corrosion not resulting from a manufacturing defect in a Covered Structural Component. (The Owner's Manual will provide guidance on preventing galvanic corrosion).
o Damage caused by spills of fuel, oil, battery acid, or other hazardous substances, or excessive exposure to incompatible cleaning agents.
o Structural weakening from unusual or extreme environmental conditions such as acid rain, industrial fallout, or excessive UV radiation beyond normal weathering.
o Mold, mildew, or fungal growth.
3.6. Unauthorized Modifications & Structural Alterations:
o Any modification, alteration, or repair to a Covered Structural Component not authorized in writing by Atchafalaya Aluminum Boats LLC. This includes, but is not limited to, unauthorized cutting, welding, drilling, or grinding of structural members.
o Installation of engines, propulsion systems, accessories, or equipment that are not compatible with the Boat's design specifications as outlined by Atchafalaya Aluminum Boats LLC, or that are improperly installed by anyone other than Atchafalaya Aluminum Boats LLC or an Atchafalaya Aluminum Boats LLC -authorized facility, if such installation or incompatibility causes damage to a Covered Structural Component.
o Alteration of flotation chambers, bulkheads, or transom reinforcements in a manner not approved in writing by Atchafalaya Aluminum Boats LLC.
3.7. Excluded Components & Non-Warranted Items:
This Lifetime Hull Warranty applies ONLY to the Covered Structural Components listed in Section 1.2. All other parts and components of the Boat are EXCLUDED from this Lifetime Hull Warranty. These excluded items include, but are not limited to:
o Propulsion Systems:
Engines (outboard/inboard), propellers, jet drives, fuel tanks (other than aluminum tanks built by Atchafalaya Aluminum Boats LLC), fuel lines, and related fuel system components. (These items are typically covered by their respective manufacturer's warranties, which will be provided to you).
o Electrical Systems:
Batteries, wiring, switches, lights, gauges, electronics (GPS, fish finders, radios, etc.), and fuse panels. (These items are typically covered by their respective manufacturer's warranties. Workmanship for installation by Atchafalaya Aluminum Boats LLC may be covered under a separate, shorter-term limited warranty, if specified at the time of sale).
o Upholstery & Interior Components:
Seats, flooring, carpets, canvas, covers, trim, dashboards, storage compartments, consoles (unless the console is built and installed by Atchafalaya Aluminum Boats LLC).
o Pumps & Plumbing:
Bilge pumps, live well pumps, plumbing lines, hoses, and transducer mounts (unless factory-welded aluminum mounts integral to the hull).
o Exterior Hardware & Accessories:
Ladders, rails, cleats, rod holders, windows, windshields, hatches, auxiliary mounts, anodes. (Unless designed, built, and installed into the hull by Atchafalaya Aluminum Boats LLC) (Anodes are sacrificial and require periodic replacement by the owner).
o Trailer & Transport Equipment:
Boat trailers, wheels, axles, bearings, hitches.
o Paint or Other Finishes or Coatings:
(Paint jobs, if done by Atchafalaya Aluminum Boats LLC, carry a 1 year limited warranty. Additional details on this will be covered later in this contract if applicable.)
o Any item added or installed by the dealer or owner.
o Note on Third-Party Warranties:
For components not manufactured by Atchafalaya Aluminum Boats LLC, any applicable warranties are those of the respective manufacturers. Atchafalaya Aluminum Boats LLC will pass through any such assignable warranties to you. Atchafalaya Aluminum Boats LLC itself provides NO warranty on these third-party components beyond what is stated here or in a separate written Atchafalaya Aluminum Boats LLC warranty document for specific installed systems (if any).
4. OWNER’S RESPONSIBILITIES
To maintain this Warranty in effect, you must:
• Operate, maintain, and store the Boat in accordance with the instructions and recommendations in the Owner's Manual provided by Atchafalaya Aluminum Boats LLC at the time of purchase.
• Keep records of all maintenance performed on the Boat.
• Inspect the Boat regularly for any potential issues.
• Take reasonable steps to protect the Boat from further damage if a defect is discovered.
5. HOW TO MAKE A WARRANTY CLAIM
5.1. Notice Requirement:
If you believe you have a claim covered by this Warranty, you must notify Atchafalaya Aluminum Boats LLC in writing within thirty (30) days of discovering the potential defect. Failure to provide timely notice may void your claim.

5.2. Required Information:
Your written notice must include:
o Your name, address, and phone number.
o The Boat Model and Hull Identification Number (HIN).
o Proof of original purchase (e.g., copy of bill of sale).
If you are a Second Owner, include proof of transfer.
o A detailed description of the nature of the defect or problem.
o Clear photographs or videos of the defect.
o Date of discovery of the defect.
5.3. Inspection and Authorization:
Upon receipt of your claim, Atchafalaya Aluminum Boats LLC will review the information. We may require you to make the Boat available for inspection by Atchafalaya Aluminum Boats LLC or its authorized representative at our facility in Maryland or another location designated by us. No repair or replacement work under this Warranty may be performed without prior written authorization from Atchafalaya Aluminum Boats LLC. Any unauthorized repairs may void this Warranty.
5.4. Transportation Costs:
The Owner is responsible for all costs associated with transporting the Boat to and from the Atchafalaya Aluminum Boats LLC facility or other authorized repair location for warranty inspection and service. Atchafalaya Aluminum Boats LLC is not responsible for any costs related to hauling, launching, towing, storage, or other incidental expenses incurred in making the Boat available for warranty service.
5.5. US Coast Guard Compliance:
This boat was manufactured to meet or exceed all applicable U.S. Coast Guard safety standards and federal regulations in effect at the time of its manufacture. This warranty is separate from any obligations related to safety recalls that may be required by law.
6. IMPORTANT LEGAL TERMS & DISCLAIMERS
6.1. EXCLUSIVE REMEDY:
THE REPAIR OR REPLACEMENT OF DEFECTIVE COVERED STRUCTURAL COMPONENTS, AT ATCHAFALAYA ALUMINUM BOATS LLC'S SOLE OPTION AS PROVIDED HEREIN, IS THE ORIGINAL OWNER'S AND (IF APPLICABLE) SECOND OWNER'S SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH OF THIS LIMITED LIFETIME HULL WARRANTY.
6.2. DISCLAIMER OF OTHER WARRANTIES:
THIS LIMITED LIFETIME HULL WARRANTY IS THE ONLY EXPRESS WARRANTY PROVIDED BY ATCHAFALAYA ALUMINUM BOATS LLC FOR THE COVERED STRUCTURAL COMPONENTS OF THE BOAT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATCHAFALAYA ALUMINUM BOATS LLC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ANY IMPLIED WARRANTIES THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW (INCLUDING THOSE UNDER THE MAGNUSON-MOSS WARRANTY ACT, IF APPLICABLE) ARE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS LIMITED LIFETIME HULL WARRANTY (OR THE FIFTEEN-YEAR TRANSFERABLE PERIOD FOR A SECOND OWNER).
Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
6.3. LIMITATION OF LIABILITY:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATCHAFALAYA ALUMINUM BOATS LLC SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR INDIRECT DAMAGES RESULTING FROM ANY DEFECT IN THE BOAT OR BREACH OF THIS WARRANTY, INCLUDING BUT NOT LIMITED TO: LOSS OF USE OF THE BOAT, LOSS OF TIME, INCONVENIENCE, LOST PROFITS OR REVENUE, RENTAL EXPENSES, LODGING OR TRAVEL COSTS, TOWING, STORAGE, OR DAMAGES TO PERSONAL PROPERTY. THE TOTAL LIABILITY OF ATCHAFALAYA ALUMINUM BOATS LLC UNDER THIS WARRANTY, OR OTHERWISE ARISING FROM THE SALE OR USE OF THE BOAT, SHALL IN NO EVENT EXCEED THE ORIGINAL RETAIL PURCHASE PRICE PAID BY THE ORIGINAL OWNER FOR THE BOAT. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
6.4. Force Majeure:
Atchafalaya Aluminum Boats LLC shall not be liable for any delay or failure to perform its obligations under this Warranty if such delay or failure is caused by circumstances beyond its reasonable control, including but not limited to: acts of God, war, terrorism, civil unrest, labor disputes, material shortages, supply chain disruptions, epidemics, pandemics, government orders or restrictions, or natural disasters.
6.5. Governing Law & Dispute Resolution:
o Governing Law:
This Warranty and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the State of
Maryland, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
o Dispute Resolution; Binding Arbitration:
ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND ATCHAFALAYA ALUMINUM BOATS LLC ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF THE BOAT, THIS WARRANTY, OR THE BOAT ITSELF, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.
o The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be held in Charles County, Maryland.
o The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.
o Waiver of Jury Trial and Class Action:
BY AGREEING TO THIS WARRANTY, YOU ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.
6.6. Severability:
If any provision of this Warranty is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
6.7. Entire Agreement & Modification:
This Warranty document, along with the Owner's Manual and the original purchase agreement, constitutes the entire agreement between you and Atchafalaya Aluminum Boats LLC concerning warranty coverage for the Covered Structural Components.
No employee, dealer, or other agent of Atchafalaya Aluminum Boats LLC is authorized to make any warranty, representation, or promise that differs from or modifies the terms of this Warranty, unless it is in writing and signed by an authorized officer of Atchafalaya Aluminum Boats LLC.
6.8. Owner's Manual:
You acknowledge receipt of the Atchafalaya Aluminum Boats LLC Owner's Manual, which contains important information regarding the safe operation, maintenance, and care of your Boat, as well as details that support this Warranty. Failure to follow the guidelines in the Owner's Manual may void this Warranty.
7. ACCEPTANCE OF WARRANTY TERMS
By completing the purchase of the Boat and accepting delivery, the Original Owner acknowledges having read, understood, and agreed to all terms and conditions of this Atchafalaya Aluminum Boats LLC Limited Lifetime Hull Warranty.
